Why is the classic tourist license becoming uncertain in Spain?

For several years, many Spanish municipalities — Barcelona, Palma, Alicante, Torrevieja, Madrid in the lead — have considerably tightened their conditions for obtaining individual tourist licenses. Saturated areas see new applications frozen or denied, and regulations change by municipality, creating real uncertainty for investors.

In addition to this municipal pressure, there is now a constraint of private law: since the reform of the Law on Horizontal Ownership, any short-term tourist rental — defined as a rental of a maximum of 10 consecutive days (9 nights) — in a condominium building requires the agreement of two-thirds of the owners of the community. A vote that can take place at any time — including after your acquisition — and block or cancel a rental activity that is legally authorized by the town hall. This additional uncertainty makes the individual license model structurally fragile for an investor wishing to secure his return over the long term.

Since July 2025, the Single Rental Registry (NRU) has become mandatory for all rentals on platforms such as Airbnb or Booking.com. This administrative obligation is in addition to the local constraints already in place, making the management of an individual license increasingly complex and time-consuming.

The individual licence remains viable in certain sectors, but it exposes the investor to regulations that vary from one municipality to another, to a personal administrative burden and to the risk of calling into question the operation. A structured alternative exists: the tourist residence with a single manager.

What is a tourist residence in Spain?

A tourist residence is a real estate complex designed from the outset for tourist accommodation, professionally operated by a single manager. Unlike an individually rented apartment, the operating permit is integrated into the project as soon as it is built, which provides much greater legal certainty.

In concrete terms, you are buying an apartment or a suite in a residence with shared facilities (swimming pool, concierge service, common areas), managed by a professional operator who takes care of all marketing, maintenance and customer relations. You receive your share of rental income without any direct management to be carried out.

This model has several fundamental advantages:
The operating permit is included in the project, without any administrative procedure on your part. Management is fully delegated to a single professional, eliminating the constraints of finding tenants, inventories or rotations. The pooling of services (maintenance, cleaning, reservations, reception) makes it possible to optimize costs and increase the occupancy rate. Finally, the contractual framework governing the return on investment offers you visibility on your return on investment from the moment of acquisition.

Why invest between Dénia and Almería?

The Spanish Mediterranean coast, from Dénia in the north of the Costa Blanca to Almería in Andalusia, concentrates an exceptional combination of factors favourable to tourist rental investment. Tourism is annual, driven both by European customers (British, French, German, Scandinavian, Eastern European countries) and by a notable growth in North American and Middle Eastern visitors.

Property prices remain significantly more affordable than in France or Italy for equivalent properties, with a strong upward valuation dynamic. Rental demand is sustained all year round thanks to more than 300 days of sunshine, quality infrastructure and direct air access from the majority of major European cities.

Investing in Spain as a non-resident (EU and non-EU)

Tourist residences are particularly suitable for non-resident investors, whether they are domiciled in the European Union (France, Belgium, Switzerland, etc.) or outside the EU (Turkey, United States, Canada). The turnkey model avoids the constraints of remote management that often complicate traditional rental investment.

In terms of taxation, non-residents are subject to IRNR (Impuesto sobre la Renta de No Residentes), the Spanish tax on income from Spanish sources. Its rate is 19% for tax residents of the European Union and 24% for non-EU nationals, unless there is a more favourable bilateral tax treaty (France, Canada and the United States have treaties with Spain).

To invest, you will need a NIE (Número de Identidad de Extranjero), equivalent to the Spanish tax number, as well as a bank account in Spain. These procedures are simple and can be carried out remotely with a power of attorney.
